These Terms and Conditions ("Terms") govern access to and use of the Services provided by FXNL Science, LLC.

By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

The Services are intended solely for individuals eighteen (18) years of age or older.

By using the Services, you represent that you meet this requirement.

2. Educational Purpose Only

All Services are provided solely for educational and informational purposes.

Nothing contained within the Services constitutes:

• Medical advice
• Diagnosis
• Treatment
• Emergency care
• Physician services
• Mental health treatment
• Healthcare services

Use of the Services does not create:

• Physician-patient relationships
• Therapist-patient relationships
• Emergency care relationships
• Fiduciary healthcare relationships

3. Assumption of Risk

Participation in exercise, fitness, nutrition, and wellness activities involves inherent risks including, but not limited to:

• Illness
• Injury
• Disability
• Cardiovascular events
• Musculoskeletal injury
• Falls
• Death

Users voluntarily assume all risks associated with participation in the Services.

Users should obtain physician clearance before beginning any exercise, nutrition, or wellness program.

Users should immediately discontinue participation and seek emergency medical attention if symptoms including chest pain, dizziness, severe shortness of breath, fainting, neurological symptoms, or other concerning symptoms occur.

4. No Guarantees

Results vary significantly between individuals.

We make no guarantees regarding:

• Weight loss
• Body composition
• Performance outcomes
• Medical outcomes
• Health improvements
• Financial outcomes
• Educational outcomes

5. Memberships and Billing

The Services may include:

• Fixed-term programs
• One-time purchases
• Recurring subscriptions
• Monthly memberships
• Annual memberships
• Digital products
• Educational services

Recurring subscriptions renew automatically until cancelled.

Users are responsible for reviewing billing terms prior to purchase.

6. Refund Policy

ALL SALES ARE FINAL.

NO REFUNDS WILL BE PROVIDED.

This includes, but is not limited to:

• Digital products
• Educational materials
• Coaching services
• Subscription fees
• Downloadable resources
• Fixed-term programs
• Memberships

By purchasing Services, users acknowledge and agree to this no-refund policy.

7. Cancellation Policy

Certain fixed-term programs, including FXNL Foundations and similar structured programs, may require completion of the committed term and may not be cancelled during the active commitment period.

For eligible recurring subscriptions, cancellation prevents future billing but does not terminate access until the end of the current paid billing period.

8. Failed Payments

We reserve the right to suspend or terminate access for failed, declined, disputed, or reversed payments.

Access may remain suspended until payment issues are resolved.

9. Intellectual Property

All content provided through the Services is the exclusive property of FXNL Science, LLC and is protected by intellectual property laws.

Protected materials include, but are not limited to:

• Workouts
• PDFs
• Lab Drops
• Videos
• Graphics
• Calculators
• Spreadsheets
• Educational materials
• App content
• Branding
• Logos
• Course materials
• Written content
• Research summaries
• Coaching systems

Users may not:

• Copy
• Reproduce
• Redistribute
• Republish
• Screenshot
• Share
• Sell
• License
• Upload
• Archive
• Reverse engineer
• Publicly display
• Commercialize
• Modify
• Create derivative works from any Company content without prior written permission.

Printing is prohibited unless explicitly authorized by the Company.

10. Artificial Intelligence Restrictions

Users may not:

• Scrape Company content
• Use automated extraction tools
• Use Company content for AI training
• Use Company content for machine learning datasets
• Use Company content to fine-tune models
• Generate derivative datasets from Company content
• Archive Company content for automated systems

Unauthorized use for artificial intelligence or machine learning purposes is strictly prohibited.

11. User Conduct

Users agree not to:

• Harass others
• Post unlawful content
• Violate intellectual property rights
• Misrepresent identity
• Circumvent security systems
• Share account access
• Interfere with platform functionality
• Upload malicious software
• Engage in abusive conduct

We reserve the right to remove content, suspend accounts, or terminate access at our sole discretion.

12. User Content and Testimonials

Users may voluntarily submit:

• Testimonials
• Reviews
• Messages
• Progress photos
• Community content
• Transformation content

By voluntarily submitting such materials, users grant FXNL Science, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and publish submitted content for marketing, educational, promotional, operational, and business purposes.

13. Community and Platform Moderation

We reserve the right to:

• Remove content
• Restrict participation
• Suspend accounts
• Terminate memberships
• Moderate discussions
• Restrict community access

at our sole discretion.

14. Third-Party Services

The Services may integrate with third-party providers.

We are not responsible for:

• Third-party outages
• Third-party policies
• Third-party security
• Third-party content
• Third-party functionality

15. Affiliate Relationships

Certain content may contain affiliate links or promotional relationships.

We may receive compensation from qualifying purchases or referrals.

16. Arbitration Agreement

Any dispute arising from or relating to the Services shall be resolved exclusively through binding individual arbitration.

Users waive:

• Jury trial rights

Before initiating arbitration, users must provide written notice of disputes and allow thirty (30) days for informal resolution.

19. Indemnification

Users agree to indemnify and hold harmless FXNL Science, LLC from claims, liabilities, damages, expenses, or losses arising from:

• Policy violations
• Misuse of Services

• Third-party claims

20. Force Majeure

We shall not be liable for delays or failures resulting from events beyond reasonable control, including:

• Internet outages
• Cyberattacks
• Platform failures
• Government actions
• Illness
• Labor disruptions
• Supply disruptions
• Emergencies

21. Modifications

We reserve the right to modify these Terms at any time.

Continued use of the Services constitutes acceptance of updated Terms.
